Al aplicar los principios establecidos en la sentencia Avotiņš/Letonia con respecto al artículo 6, apartado 1, del CEDH y el derecho a un juicio justo en un caso como el de autos, se deduce que, en principio, el Estado miembro requerido no puede revisar la validez o el carácter ejecutivo del instrumento mientras el demandante no haya agotado los recursos locales.
Applying principles established in Avotiņš v. Latvia with respect to Article 6(1) of the ECHR and the right to a fair hearing to a case such as the present, it follows that, normally, the requested Member State is precluded from reviewing the validity or enforceability of the instrument, where the plaintiff has not exhausted local remedies.
