El Tribunal de Justicia ha interpretado la condición de órgano jurisdiccional como un concepto autónomo del Derecho de la Unión, teniendo en cuenta, a este respecto, un conjunto de factores, como son el origen legal del órgano que le remite la petición, su permanencia, el carácter obligatorio de su jurisdicción, el carácter contradictorio del procedimiento, la aplicación por parte de dicho órgano de normas jurídicas, y su independencia.
Status as a court or tribunal is interpreted by the Court of Justice as a self-standing concept of European Union law, the Court taking account of a number of factors such as whether the body making the reference is established by law, whether it is permanent, whether its jurisdiction is compulsory, whether its procedure is inter partes, whether it applies rules of law and whether it is independent.
