En cuanto al informe sobre las resoluciones dictadas en rebeldía, probablemente el aspecto más delicado se relaciona con el hecho de que, en algunos Estados miembros, cuando se dictan sentencias en rebeldía, la solución consiste en iniciar un nuevo proceso, lo que respeta plenamente lo establecido en el Convenio Europeo para la Protección de los Derechos Humanos (Protocolo nº 7, artículo 2), así como el Pacto Internacional de Derechos Civiles y Políticos, mientras que otros países sólo reconocen el derecho de recurso.
Concerning the report on decisions rendered in absentia, probably the most sensitive aspect relates to the fact that, in some Member States, when judgments are rendered in the absence of the defendant, the solution is to have a retrial, thus fully respecting the European Convention on Human Rights (Protocol No 7, Article 2) and the International Covenant on Civil and Political Rights, whereas other countries recognise only the right to an appeal.
