Habida cuenta de esos objetivos y de su contexto global y específico, el Tribunal de Justicia considera que el concepto de «residencia legal» que permite adquirir el derecho de residencia permanente debe interpretarse como una residencia de conformidad con las condiciones previstas por esa Directiva (a saber, ser un trabajador por cuenta ajena o por cuenta propia en el Estado miembro de acogida o disponer, para sí y los miembros de su familia, de recursos suficientes para no convertirse en una carga para la asistencia social del citado Estado y de un seguro de enfermedad).
In the light of those objectives and the Directive’s overall and specific context, the Court considers that, for the purpose of the acquisition of a right of permanent residence, the term ‘legal residence’ must be construed as a period of residence which complies with the conditions laid down in the Directive (namely, the person concerned must be a worker or self-employed person in the host Member State or have sufficient resources and sickness insurance cover for himself and his family members).
