El TJ ha sostenido que el concepto de ventaja social comprende todas las ventajas que, vinculadas o no a un contrato de trabajo, se reconocen generalmente a los trabajadores nacionales por razón, principalmente, de su condición objetiva de trabajadores o por el mero hecho de su residencia en territorio nacional y cuya extensión a los trabajadores nacionales de otros Estados miembros permite, por tanto, facilitar su movilidad en la UE[74].
The CJ has held that social advantages cover all advantages, whether or not linked to a contract of employment, that are generally granted to national workers primarily because of their objective status as workers or by virtue of the mere fact of their residence on the national territory, and the extension of which to workers who are nationals of other Member States seems likely to facilitate their mobility within the EU[74].
