El Tribunal de Justicia concluye que una retribución inferior de las horas realizadas por un funcionario empleado a tiempo parcial fuera de su tiempo de trabajo individual y hasta el límite del tiempo de trabajo de un funcionario empleado a tiempo completo vulnera el principio de igualdad de retribución entre trabajadoras y trabajadores cuando esta diferencia de trato afecta a un número considerablemente más elevado de mujeres que de hombres y no está justificada por factores objetivos y ajenos a toda discriminación por razón de sexo.
