El Consejo de Europa, en su Recomendación n° R (99) 19 del Comité de Ministros del Consejo de Europa del 15 de septiembre de 1999 sobre la mediación en materia penal, da la siguiente definición del término mediación penal: «cualquier proceso que permita a la víctima y al delincuente participar activamente, si dan su consentimiento libremente para ello, en la solución de las dificultades resultantes del delito, con la ayuda de un tercero independiente (mediador)».
Recommendation No R (99)19 of the Committee of Ministers of the Council of Europe of 15 September 1999 concerning mediation in penal matters contains the following definition of mediation: "any process whereby the victim and the offender are enabled, if they freely consent, to participate actively in the resolution of matters arising from the crime through the help of an impartial third party (mediator)".
