Sin embargo, la Sala de Recurso no se equivocó al determinar que no había similitudes fonéticas entre los signos –como declaró el Tribunal General–, sino que analizó correctamente las similitudes fonéticas entre éstos, concluyendo que a pesar de las similitudes fonéticas entre ellos, la sonoridad global de los signos es diferente.
However, the Board of Appeal did not, as the General Court stated, err in finding that there was no phonetic similarity between the signs, but instead correctly analysed the phonetic similarity between the signs, and concluded that despite the phonetic similarities between the signs, the global sonority of the signs is different.
