A este respecto procede constatar que, tras haber considerado, en el apartado 47 de la sentencia recurrida, que procedía anular la Decisión controvertida a causa de la violación del derecho de defensa de la PMOI, el Tribunal de Primera Instancia indicó en el apartado 48 de dicha sentencia que, aunque no era necesario pronunciarse sobre los demás motivos de recurso, examinaría sin embargo el segundo y el tercer motivos de recurso, dada su importancia desde el punto de vista del derecho fundamental a una tutela judicial efectiva.
In this regard, it is to be noted that the General Court, after finding at paragraph 47 of the judgment under appeal, that the contested decision must be annulled by reason of breach of the PMOI’s rights of defence, considered at paragraph 48 that, although it was not necessary, in those circumstances, to consider the other pleas in law in the action, it would none the less examine the second and third pleas in law raised before it, having regard to their importance in relation to the fundamental right to effective judicial protection.
