Este aspecto se puso de relieve en la sentencia del Tribunal Europeo de 13 de mayo de 1997 relativa a la DSGD( [9]): al rechazar la demanda de anulación de la cláusula, presentada por el Gobierno alemán, el Tribunal manifestaba, en especial, lo siguiente: "teniendo en cuenta la complejidad de la materia y las divergencias que subsistían entre las legislaciones de los Estados miembros, el Parlamento y el Consejo estaban facultados para proceder de forma progresiva a la armonización necesaria".
This aspect was emphasised in the European Court's judgement of 13 May 1997, related to the DGSD ( [9]): in rejecting the action for annulment of the clause brought by the German Government, the Court states, in particular, that "in view of the complexity of the matter and the differences between the legislation of the Member States, the Parliament and the Council were empowered to achieve the necessary harmonisation progressively".
