The EFTA Surveillance Authority has decided to close the formal investigation procedure pursuant to Article 1(2) in Part I of Protocol 3 to the Surveillance and Court Agreement regarding RD aid granted by the Research Council of Norway in connection with the development of the software programme Turborouter because it was granted in accordance with the existing aid scheme Industrial RD Programmes in line with Article 61(3)(c) of the EEA Agreement and the State Aid Guidelines on Research and Development.

In the following, the Authority will assess whether the application of the scheme Industrial RD Programmes to the four concrete projects identified as relating to the development of the software programme Turborouter was done in line with Article 61(3)(c) of the EEA Agreement on the basis of the provisions of the 1994 RD Guidelines.

According to the Basque Government document entitled Industrial Policy: General Framework of Activities 1996-1999 (Política Industrial. Marco General de Actividades 1996-1999), "tax policies are essential for boosting economic development and, similarly, for promoting industrial projects based on the industrial development of the Basque Country" (page 131), and in the chapter "Tax policy instruments" one reads: "the tax autonomy which we have (in the Basque Country) enables us to search for imaginative made-to-measure tax solutions, e.g. for priority projects or even tax incentives for large firms" (page 133).

4. In order to help ACP enterprises in their efforts to find new sources of supply with a view to benefiting to the maximum extent from the provisions of the Protocol as regards cumulation of origin, steps will be taken to ensure that the Centre for the Development of Enterprise provides assistance to ACP operators in the establishment of appropriate contacts with suppliers in the ACP States, the Community and the countries and territories, as well as to promote relations in the field of industrial cooperation among the operators concerned.

(65) Three programmes, namely the Regional Industrial Development Programme (RIDP), the Simplified Regional Industrial Development Programme (SRIDP), and the General Export Incentive Scheme, were not investigated.
